📋 The short version: Use the app legally and honestly. Don't misuse the spam reporting system. All purchases are final. We keep the service running as best we can but can't guarantee 100% uptime.
1. About us
Who's Calling + SPAM Guard is a product of Dexter Galactic (ABN: 14456542898), a business registered in South Australia, Australia. References to "we", "us" and "our" in these Terms refer to Dexter Galactic trading as Who's Calling + SPAM Guard.
2. Acceptance of terms
By downloading, installing, or using Who's Calling + SPAM Guard ("the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
These Terms apply to all users, including anyone who downloads or installs the App.
3. Description of the service
Who's Calling + SPAM Guard is a call screening application that routes unknown incoming calls through a screening system before connecting them to you. The service:
- Prompts unknown callers to identify themselves before connecting the call.
- Provides a real-time transcript of the caller's identification to the user.
- Allows users to answer, save a written transcript of the call, or block and report callers.
- Maintains a shared database of reported spam numbers to protect all users.
- Provides call screening for unknown numbers only. Contacts in your address book always bypass screening.
4. Eligibility
You must be at least 13 years old to use the App. By using the App you represent that you meet this requirement. The App is currently available in selected countries only. Access may be restricted in your region.
5. Account and activation
You may need to create an account or enter an activation code to use the paid features of the App. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at hello@wcsg.app of any unauthorised use of your account.
6. Permitted use
You may use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App to harass, threaten, or harm any person.
- Submit false spam reports or misuse the reporting system to target legitimate numbers.
- Attempt to reverse engineer, decompile, or extract the source code of the App.
- Use the App in any way that could disable, overburden, or impair our infrastructure.
- Use the App to intercept communications in violation of applicable law.
- Violate any applicable local, national, or international law or regulation.
- Share or transfer your activation code or account to any other person.
7. Speech transcription
The App generates a real-time text transcript of what an unknown caller says when prompted to identify themselves. Speech recognition runs on our secure screening server. The caller's audio exists only in that server's memory (RAM) for the duration of the call, is never recorded and never written to disk, and is erased the moment the transcript is delivered to your device. Transcripts are stored locally on your device and are not retained on our servers.
The App does not provide voicemail recording. When you choose not to answer a call and choose to save a transcript of the call, the caller is prompted to leave a message. That message is transcribed as text only and delivered to your transcript log. No audio recording is ever made, so none is saved or stored anywhere.
The App plays a prompt to all unknown callers informing them that they are using a call screening app and asking them to state their name and reason for calling. This prompt serves as notice to callers that their spoken response will be transcribed on the recipient's device.
8. Spam reporting
When you block a number, that number is added to our shared spam database. By submitting a report you represent that:
- You received an unwanted, unsolicited, or harassing call from that number.
- You are not submitting the report in bad faith or to target a legitimate caller.
If your number has been incorrectly reported, you may request removal by emailing hello@wcsg.app with the subject "Number removal request". We will review and respond within 14 days.
9. Purchases and minute allowances
The App requires a one-time purchase to activate call screening. Minute allowances are issued at the time of purchase.
- All purchases are final. We do not offer refunds except where required by applicable consumer law.
- Minute allowances are consumed when an unknown caller is screened. Contacts bypass screening and do not consume your allowance.
- Automatically blocked calls (from the global spam database) do not consume your minute allowance.
- When your minute allowance is exhausted, you can purchase a top-up minute pack. Top-up packs are available within the App.
- Upgrading from Single SIM to Dual SIM unlocks screening for a second phone number. Upgrades do not add minutes to your existing allowance.
- Pricing is set per country and displayed on Google Play at the time of purchase. All purchases are made through Google Play and are subject to Google Play's payment terms in addition to these Terms.
10. How long your minutes last
All plans carry minutes and those minutes expire in 12 months from date of purchase of the plan, the plan itself never expires, only the minutes do.
Additionally any upgrade of a plan changes the plan only, all plans and upgrades do not expire, only the minutes do. All upgrades to a plan will carry over the plan minutes the same amount you have used or unused, the minutes expiry also does not change. Meaning those minutes that rolled over will continue on their expiry date previously set.
Any top up packs purchased will not be affected by any plan change or upgrade, they will continue as normal, the top up minutes expire 12 months from the purchase of those minutes. All plans and upgrades to plans will always use the plan minutes first before your top up packs, always!
Top up packs have an expiry date of 12 months from the date of purchase, your top up pack starts using its minutes once all minutes are consumed by your plan first, once your plan minutes are consumed or the plan expires, whichever comes first, your top up minutes will then be used. Top up pack minutes that have / have not been consumed will always expire 12 months after purchase.
11. Number provisioning and telecommunications compliance
Screening numbers are provisioned under our own telecommunications account with Telnyx Inc. We do not collect identity documents from you, and no identity verification is required of you in any country in which the app is sold.
(a) Number availability. Virtual screening numbers are subject to availability in your country. Where demand is high, provisioning may take longer than usual; we will keep you informed by email while it is outstanding. In the event a number cannot be provisioned for you at all, a full refund will be issued.
(b) Regulatory withdrawal. A telecommunications regulator may change the rules in a country and withdraw a number that was validly issued under the rules previously in force. Where that happens, the screening number ceases to function and cannot be reissued in that country. To the fullest extent permitted by law, neither Who's Calling + SPAM Guard nor Telnyx is liable for the withdrawal or for any loss arising from it, and it does not give rise to a refund of minutes already purchased. This clause applies only after a number has been successfully provisioned; clause (a) continues to govern non-provisioning. Nothing in this clause limits rights under the consumer law of your country that cannot be excluded by agreement.
12. Service availability
We aim to keep the service available at all times but cannot guarantee uninterrupted access. The service depends on third-party infrastructure including Telnyx (VoIP), Supabase (database), Firebase (push notifications), and your mobile carrier's call forwarding functionality. We are not liable for outages or degradation caused by third-party providers.
We reserve the right to modify, suspend, or discontinue any part of the service at any time. In the event of permanent discontinuation, we will provide no less than 30 days written notice by email to all active account holders. Upon discontinuation, all obligations under these Terms shall cease. No refunds of any kind will be issued for unused minute allowances, top-up packs, or any other purchases. By purchasing, you acknowledge and accept this risk as inherent to early-stage software products.
13. Intellectual property
All content, software, design, trademarks, and other intellectual property in the App are owned by or licensed to us. You may not reproduce, distribute, or create derivative works from any part of the App without our written permission.
14. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Dexter Galactic is the data controller for all personal data collected through Who's Calling + SPAM Guard.
15. Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, uninterrupted, or free of viruses or other harmful components.
We do not warrant the accuracy of the spam database. A number not flagged as spam is not guaranteed to be legitimate, and a flagged number is not guaranteed to be spam.
16. Limitation of liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
17. Indemnification
You agree to indemnify and hold us harmless from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party right.
18. Governing law
These Terms shall be governed by and construed in accordance with the laws of the state of South Australia, Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Australia, Australia.
19. Changes to these terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify active users by email. Your continued use of the App after changes constitutes acceptance of the updated Terms.
